Terms of Service

Welcome to Sookooloo. These Terms of Service (“Terms”) govern your use of the Sookooloo website, mobile applications, and any related services (collectively, the “Service”). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to all of these Terms, you must not access or use the Service.
1.1 Eligibility. You must be at least 13 years old to use Sookooloo. If you are between 13 and the age of majority in your jurisdiction, you affirm that you have obtained your parent’s or legal guardian’s consent to these Terms.
1.2 Account Creation. To access certain features, you must register for an account. You agree to provide accurate, current, and complete information during registration, and to update your information as necessary. You are solely responsible for safeguarding your password and for any activity occurring under your account.
2.1 License. Subject to your compliance with these Terms, Sookooloo grants you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the Service on your personal device for your own non-commercial, entertainment, and informational purposes.
2.2 User Conduct. You agree not to:
Use the Service for any unlawful purpose, including but not limited to infringing third-party rights or violating any applicable laws.
Attempt to gain unauthorized access to Sookooloo’s systems, data, or networks.
Interfere with or disrupt the integrity or performance of the Service (e.g., introducing viruses, bots, or other malicious code).
Use automated scripts or bots to extract data or otherwise manipulate the Service.
Impersonate any person or entity or misrepresent your affiliation with any person or entity.
Upload, post, or transmit any content that is defamatory, abusive, harassing, lewd, or otherwise objectionable.
2.3 Age-Restricted Content. Some quizzes or features may not be suitable for younger audiences. If you are under the age of majority in your jurisdiction, you must have parental consent before accessing any age-restricted content.
3.1 Your Contributions. By submitting any questions, quiz content, or other materials (“User Content”) to Sookooloo, you grant Sookooloo a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to use, host, store, modify, copy, distribute, publish, and display such User Content for the purposes of operating, promoting, and improving the Service. You represent and warrant that you own or otherwise control all rights to the User Content you submit and that submission of your User Content does not violate any third-party rights or applicable laws.
3.2 Sookooloo Content. All content available through the Service, including quizzes, questions, graphics, multimedia, scripts, and software, is owned or licensed by Sookooloo and is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, publicly display, or create derivative works of any portion of the Service except with the express prior written permission of Sookooloo.
3.3 Trademarks. “Sookooloo” and all logos, service marks, graphics, and trade dress associated with Sookooloo are the exclusive property of Sookooloo. No trademark or service mark license is granted in connection with your use of the Service.
4.1 Fees. Certain features or content may require payment of fees or a subscription. You agree to pay all fees in full and in a timely manner, in accordance with the pricing and payment terms presented to you at the time of purchase. All fees are non-refundable except as required by law or expressly provided by Sookooloo.
4.2 Billing. By providing payment information, you grant Sookooloo permission to charge your chosen payment provider for all charges at the stated price, including subscription renewals. You agree to keep your payment information current.
4.3 Promotional Offers. Any promotional offer (e.g., free trials, discounts) is subject to additional terms that will be disclosed at the time of offer. Sookooloo reserves the right to modify or cancel promotional offers at any time.
5.1 No Warranty. The Service is provided “as is” and “as available.” Sookooloo disclaims all warranties, express or implied, including, but not limited to, warranties of merchantability, fitness for a particular purpose, title, and non-infringement. Sookooloo does not warrant that the Service will be uninterrupted, error-free, or secure.
5.2 Limitation of Liability. To the fullest extent permitted by applicable law, Sookooloo, its affiliates, officers, directors, employees, agents, and licensors shall not be liable for any incidental, special, indirect, punitive, or consequential damages whatsoever, including lost profits, lost data, or losses due to business interruption, arising out of or related to your use of (or inability to use) the Service, even if advised of the possibility of such damages. In no event will Sookooloo’s total liability to you for all damages exceed the amount paid by you to Sookooloo in the past twelve months, or USD $50 if you have not paid any fees.
6.1 Termination by You. You may terminate your account at any time by following the instructions in the Service or contacting Sookooloo support. Upon termination, your right to access and use the Service will immediately cease.
6.2 Termination by Sookooloo. Sookooloo may suspend or terminate your account, block access to the Service, or remove any content at any time, without prior notice or liability, if you breach these Terms or if Sookooloo believes, in its sole discretion, that your conduct is harmful to the interests of Sookooloo, other users, or third parties.
6.3 Effect of Termination. Upon termination, sections regarding disclaimers, limitations of liability, proprietary rights, indemnification, and governing law shall survive.
7.1 Changes to the Service. Sookooloo reserves the right to modify, suspend, or discontinue, temporarily or permanently, the Service or any feature thereof at any time, without prior notice or liability.
7.2 Changes to These Terms. Sookooloo may update these Terms from time to time. When changes are made, Sookooloo will post the revised Terms with a new “Last updated” date. If you continue to use the Service after such modifications, you accept the revised Terms. We encourage you to review these Terms periodically.
8.1 Governing Law. These Terms and any disputes arising from or related to the Service will be governed by and construed in accordance with the laws of the Republic of Cameroon, without regard to its conflict of law provisions.
8.2 Arbitration. Any dispute, claim, or controversy arising out of or relating to these Terms or the breach, termination, enforcement, or validity thereof shall be resolved by binding arbitration in Yaoundé, Cameroon, under the rules of the Arbitration Center of the Cameroon Chamber of Commerce. The language of arbitration shall be English. Judgment upon the award rendered by the arbitrator(s) may be entered in any court having jurisdiction.
8.3 Class-Action Waiver. You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.
You agree to defend, indemnify, and hold harmless Sookooloo, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, and agents, from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or in any way connected with (a) your access to or use of the Service, (b) your User Content, (c) your violation of these Terms, or (d) your violation of any applicable law or rights of any third party.
10.1 Severability. If any provision of these Terms is held to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect.
10.2 Entire Agreement. These Terms, together with any policies or guidelines referenced herein (including the Privacy Policy), constitute the entire agreement between you and Sookooloo regarding the Service and supersede all prior or contemporaneous communications and proposals, whether oral or written.
10.3 Waiver. No waiver of any provision hereof shall be deemed a further or continuing waiver of such provision or any other provision, and Sookooloo’s failure to assert any right or provision under these Terms shall not constitute a waiver of such right or provision.
